Terms of Service

These Terms of Service govern the conditions and procedures for using the services (hereinafter "Services") provided by Mogak (hereinafter "Company"), and set forth the rights, obligations, and responsibilities of the Company and users, as well as other necessary matters.

The terms used in these Terms are defined as follows.

1. "Service" refers to the Mogak platform and all ancillary services provided by the Company.
2. "Member" refers to a person who has entered into a service agreement in accordance with these Terms and uses the Services provided by the Company.
3. "ID" refers to the email address set by the Member and approved by the Company for identification and use of the Services.
4. "Post" refers to information in the form of text, photos, videos, and various files and links, including symbols, characters, voice, sound, images, and videos, posted by Members while using the Services.

1. These Terms take effect for all Members who wish to use the Services.
2. The Company may amend these Terms when necessary, and shall announce any changes without delay. However, for amendments that are unfavorable to users, the Company shall provide at least 30 days' advance notice.
3. If a Member does not agree to the amended Terms, the Member may discontinue use of the Services and withdraw membership.

1. The service agreement is formed when a person who wishes to become a Member agrees to the contents of these Terms, applies for membership, and the Company accepts such application.
2. The Company may refuse to accept or may subsequently terminate the service agreement in any of the following cases:
   1. Applications by persons under 14 years of age
   2. Use of another person's identity or submission of false information
   3. Applications by persons who have previously lost membership status under these Terms
   4. Other cases where the application is found to violate these Terms, or to be illegal or improper

1. The Company provides the following services:
   1. Mogak session posting and participation services for gathering together to achieve individual goals
   2. Community and social networking services among Members
   3. All other services provided to Members through additional development or partnership agreements with other companies
2. The Services are provided 24 hours a day, 365 days a year in principle.
3. The Company may modify all or part of the Services being provided for operational or technical reasons when there is a substantial cause.

1. Members must not engage in the following activities:
   1. Registering false information when applying or making changes
   2. Misappropriating another person's information
   3. Altering information posted by the Company
   4. Transmitting or posting information other than that designated by the Company (including computer programs)
   5. Infringing on the copyrights or other intellectual property rights of the Company or third parties
   6. Damaging the reputation of the Company or third parties, or interfering with their business
   7. Posting or distributing obscene or violent messages, images, audio, or other content contrary to public order and morals

1. If a Member's post contains content that violates applicable laws such as the Act on Promotion of Information and Communications Network Utilization and Information Protection, or the Copyright Act, the rights holder may request suspension of posting or deletion of the relevant post pursuant to the procedures set forth by applicable law, and the Company shall take action in accordance with applicable law.
2. Even in the absence of a request from a rights holder pursuant to the preceding paragraph, the Company may take provisional measures with respect to a post in accordance with applicable law if there are grounds to recognize infringement of rights or if the post otherwise violates Company policy or applicable law.

1. The copyright in a post made by a Member within the Services belongs to the Member who is the author of that post.
2. When a Member posts content within the Services, the Member grants the Company a non-exclusive license to use the post for the following purposes domestically and internationally: operation, display, transmission, distribution, and promotion of the Services.
3. If the Company wishes to use a Member's post in a manner other than as described in paragraph 2, the Company must obtain the Member's prior consent by telephone, fax, email, or other means.

If a Member violates the obligations set forth in these Terms or interferes with the normal operation of the Services, the Company may restrict the Member's use of the Services in stages, including by issuing a warning, temporarily suspending access, or permanently terminating access.

1. The Company is not liable for any failure to provide the Services due to natural disasters or other force majeure events.
2. The Company is not liable for any disruption to a Member's use of the Services caused by the Member's own fault.
3. The Company is not liable in connection with the use of services provided free of charge, except where specifically provided by applicable law.

1. The laws of the Republic of Korea apply to the interpretation of these Terms and to disputes between the Company and Members.
2. Any litigation arising from disputes related to the use of the Services shall be submitted to the competent court in accordance with the Civil Procedure Act.
